Europarl 2003/09 Softwarepatent Richtlijn Amendementen: Echte vs Valse Limitering

Het Europees Parlement zal volgens de planning op 24 September over de Softwarepatent-richtlijn stemmen. De richtlijn zoals voorgesteld door de Europese Commissie vernietigt de basisstructuur van de huidige wet (Art. 52 van de Europese Patent Conventie) en vervangt het door de Trilaterale Standaard die uitgewerkt werd door de VS, Europese en Japanse Patentbureaus in 2000, volgens welke alle "computer-geïmplementeerde" probleemoplossingen patenteerbare uitvindingen zijn. Sommige lede van het Parlement hebben amendementen voorgesteld met als doel het striktere uitvindingsconcept van de Europese Patent Conventie te bewaren, terwijl anderen kiezen voor ongelimiteerde patenteerbaarheid volgens de Trilaterale Standaard, maar wel in een rethorische vorm van beperkingen. We proberen een vergelijkende analyse te maken van alle voorgestelde amendementen om beslissingmakers te helpen herkennen of ze stemmen voor echte of valse limitering van patenteerbaarheid.

Het kan niet het doel zijn van de huidige richtlijn om alle soorten "computer-geïmplementeerde" ideeën patenteerbare uitvindingen te maken. Het doel is veeleer om de limieten van patenteerbaarheid i.v.m. automatische gegevensverwerking en zijn verschillende (technische en niet-technische) toepassingsgebieden te verduidelijken, en dit moet uitgedrukt worden in de titel in duidelijke en ondubbelzinnige bewoording.

Synopsis:
Ideas implemented in generic computer hardware are not inventions in the sense of Art 52(2) EPC. The term "computer-implemented invention" is not known to the man skilled in the art, and since the only things that can be implemented in a computer are computer programs (a washing machine or mobile phone cannot be implemented in a computer), it suggest that computer programs can be inventions. It was introduced by the EPO in 2000 in the infamous Appendix 6 of the Trilateral Website document in order to bring European patent law in line with US and JP and to allow patents for "computer-implemented business methods", in anticipation of a deletion of Art 52(2) EPC.

Een directieve die patenteerbaarheid laat afhangen van het woord "technische bijdrage" moet deze term duidelijk uitleggen.

Amendement 96 lijkt erop te wijzen dat alleen het probleem maar niet de oplossing technisch moet zijn. Het woord "significant" heeft geen wettelijke betekenis en is daardoor eerder aanleiding tot verwarring dan verduidelijking. Natuurlijk moet "technisch" duidelijk gedefinieerd worden om een bruikbaar effect te hebben. Eisen dat een technisch probleem opgelost moet worden is zo slecht als CEC of erger. We moeten niet focussen op de toepassing (het opgeloste probleem), maar op de oplossing (het resultaat van empirisch onderzoek dat een patent kan verdienen). Van alle software kan gezegd worden dat het een technisch probleem oplost, maar als de oplossing alleen in de software innoveert, kan er niet gezegd worden dat het een technische oplossing is (tenminste niet een nieuwe technisch oplossing). Als je bekende fysische middelen neemt en ze gebruikt als uitwendige uitrusting voor een computer, kan je alle soorten technische problemen oplossen door programmeren. Dat maakt van deze oplossingen echter geen uitvindingen of leereffect dat ze bijdragen aan een technische bijdrage. (de laatste 2 zinnen zijn synoniem, uitvinding = technische bijdrage) Aan de andere kant kan een technische en patenteerbare uitvinding perfect een niet-technisch probleem oplossen (b.v. een computerchip kan alleen heel snel eenvoudige berekeningen maken, iets wat geen technisch probleem is), dus dit amendement zou zelfs uitvindingen uitsluiten die anders patenteerbaar zouden zijn afhankelijk van de interpretatie of definitie van technisch.

Amendment 69 goes in the right direction by stating that "processing, handling, and presentation of information do not belong to a technical field". It risks mixing the "technical contribution" (= invention) requirement with non-obviousness requirements, similar to 96. However even though the wording is redundant, there is nothing wrong with saying that the contribution (invention) must be "non-obvious". This can even help to correct EPO misperceptions, according which "the non-obviousness must contain a technical contribution". Given that this amendment also defines what "technical fields" (Art 27 TRIPs) are, it is extremely useful.

Uiteindelijk krijgt amendement 107 het goed: dit stelt duidelijk dat "technische bijdrage" een synoniem is voor uitvinding en herhaalt de patenteerbaarheidsvereisten van Art. 52 EPC. Synopsis:
Since the rapporteur's attempt to "make it clear what is patentable and what not" hinges entirely on the word "technical", this term must be defined clearly and restrictively. The only definition which achieves this is the one along the lines of amendment 55 and 97 (amendments 37, which is also good, will be retracted to avoid a conflict with this one), which is found in various national case laws and in some patent laws (e.g. Nordic Patent Treaty and patent laws of Poland, Japan, Taiwan et al). This definition is based on valid concepts of science and empistemology and has been proven to have a clear meaning in practise. It assures that broad, expensive and insecurity-fraught broad exclusion rights such as patents are used only in areas where there is an economic rationale for them, and that abstract-logical innovation is the domain of copyright and copyright-like sui generis rights only. The word "numerical" in Amendment 45 is apparently the result of mistranslation from French. The rough definition given here corresponds to the worldwide common understanding of the term, implicit in current-day case law and in the JURI report other statements about what should be patentable (e.g. "not software as such, but inventions related to mobile phones, engine control devices, household appliances, ..." ). This understanding should be made explicit for the purpose of clarification.

Synopsis:
Het is één van de belangrijkste doelstellingen van het richtlijnproject geweest om Art 52 EPC te verduidelijken in het licht van Art 27 TRIPs, dat zegt dat "uitvindingen in alle gebieden van de technologie" octrooieerbaar moeten zijn. We stellen voor om Art 52 EPC te vertalen in de taal van Art 27 TRIPs, op de lijn van Amendement CULT-16.

AG is vandaag een onmiskenbaar hulpmiddel geworden in alle domeingen van de menselijke maatschappij en zal dat blijven in de toekomst. Het is alomtegenwoordig. ... Zijn instrumentele betekenis, zijn hulp- en ondersteuningsfunctie onderscheiden AG van de ... individuele technologiegebieden en en het is net als bij gebeiden zoals bedrijfsadiminstratie, waarvan de werkresultaten en -methodes ... nodig zijn voor alle bedrijven en waarvoor daarom is er bij voorbaat nood aan de vrije beschikbaarheid ervan.

CULT heeft goed geadviseerd om te stemmen voor een duidelijke uitsluiting van gegevensverwerking van het gebied van "technologie".

Talrijke studies, waarvan sommige uitgevoerd door EU-instellingen alsook de opinies van het Europees Economisch en Sociaal Comité en het Europees Comité van de Regio's verklaren in detail waarom Europa's economie schade zal leiden, als gegevensverwerking-innovaties niet duidelijk uitgesloten worden van octrooieerbaarheid.

Deletion, as proposed by amendment 82, could be helpful, because the only effect of this paragraph is to confuse patentability tests and thereby make it impossible for national patent offices to reject non-statutory patent applications without substantive examination. Amendment 16 makes the same mistake as the commission text, it just tidies up the language a bit. Amendment 40 will be retracted, it has been retabled as an insertion now (83).

Synopsis:
Wanneer je een uitvinding octrooieert, claim je een bepaalde toepassing van deze uitvinding. Deze aanvraag is wat in de octrooiconclusie wordt beschreven. Als zodanig, bevat de octrooiconclusie (als geheel beschouwd) zowel de uitvinding zelf, als een aantal niet-octrooieerbare kenmerken (zoals bijvoorbeeld een computerprogramma) die benodigd zijn voor de genoemde toepassing van de uitvinding. Dit betekent dat zelfs als wordt geëist dat de uitvinding een technisch karakter heeft, de octrooiconclusie niet-technische kenmerken kan hebben (waar wij helemaal geen bezwaar tegen hebben, zo hebben octrooien altijd gewerkt).

Echter, het voorstel van de Europese Commissie ontkracht haar eigen concept van "technische bijdrage" door toe te staan dat de bijdrage bestaat in niet-technische kenmerken. De versie van de JURI stelt alleen dat de octrooiconclusie technische kenmerken moet omvatten, maar dit is geen echte beperking. Een voorbeeld kan dit verduidelijken. Stel dat wij een computerprogramma willen patenteren, dus we zeggen dat het de "technische bijdrage" is. In de octrooiconclusie beschrijven we de toepassing van dit programma, dus ze zeggen dat we de uitvoering van dit programma op een computer octrooieren. Nu claimt het octrooi als geheel technische kenmerken (de computer), en het onderscheid tussen de claims als geheel (bestaande computer+nieuw programma) en de stand van de techniek (bekende computer) is het computerprogramma. Dus een computerprogramma kan volgens deze voorwaarde een technische bijdrage zijn, wat zichzelf volledig tegenspreekt (omdat een computerprogramma niet technisch kan zijn). Het is duidelijk dat een correctie als in amendement 57=99=110 noodzakelijk is, als het concept van "technische bijdrage" al wordt gebruikt.

De gratieperiode voor een nieuwheid, voorgesteld door amendement 100, is een orthogonale kwestie. Zoals aangetoond door een recente raadpleging gevoerd door het Patentbureau van het Verenigd Koninkrijk is het heel controversieel, zelfs onder hen die verondersteld worden ervan te profiteren. Het is niet duidelijk of een gratieperiode voor een nieuwheid in feite, zoals door het ITRE rapport wordt gesuggereerd, MKB's ten goede zou komen. In het geval van open source ontwikkeling zou het zelfs bijkomende onzekerheid veroorzaken over of gepubliceerde ideeën vrij van octrooien zijn.

Zoals genoemd in de analyse van Verklaring 11, zijn "uitvinding" en "technische bijdrage" synoniemen: wat je hebt uitgevonden, is jouw (technische) bijdrage tot de stand der techniek. In het jargon dat wordt gebruikt door de Richtlijn betekent "technische bijdrage" alleen "oplossing voor een technisch probleem binnen de stap van de naaste stand der techniek tot de geclaimde uitvinding". In deze context is het onduidelijk welk effect een toets, hoe strict dan ook, zou kunnen hebben, want het is niet duidelijk waar het betrekking op heeft. Door te zeggen dat deze toets "van toepassing moet zijn", sluit de bepaling niet duidelijk een keuze tussen deze en andere toetsen uit. Het zou zinvoller zijn geweest om te stellen dat een "technische uitvinding" (=technische bijdrage) een "inzicht ..." is. Tenslotte is er geen wettelijke definitie van %q(industriële toepassing in de stricte zin van de uitdrukking, in termen van zowel methode als resultaat), wat betekent dat dit deel van het amendement er niet in slaagt verklaring te bereiken. Toch bevelen we aan dit amendement te steunen, want het legt centrale aspecten van het concept van technische uitvinding vast, en kan daardoor, in combinatie met andere amendementen, uiteindelijk tot verklaring leiden. In spite of these shortcomings, we recommend to support Amendment 70. At least it codifies central aspects of the concept of "technical invention". Thereby, in combination with other amendments, it could eventually contribute to drawing a clear limit of patentability.

It might be a good idea to replace "technical production processes operated by such a computer" by "the inventive processes running on such a set of equipment" if that is still possible in the form of a "compromise amendment". Amendment 102 defines "computer-implemented invention" as being only a product or a technical production process. As long as "technical" is defined, this might be useful. Nevertheless, a computer running a program could also be interpreted as a "programmed device", and patenting the use of a computer program when executed on a computer has the same effect as patenting the computer program itself: there is no other way to use a computer program than by executing it on a computer.

These amendments do, unlike some may think, not serve to promote protect free/opensource software, but rather to ensure that the obligation of disclosure which is inherent in the patent system is taken seriously and that software is, like any other information object, on the disclosure side of the patent rather than on its exclusion/monopolisation side. This makes it a little more difficult to block people from doing things you even haven't done yourself, but which are obviously possible since the computing model is perfectly defined and you always know what you can do with a computer. When you publish working source code you at least offer some real knowledge on how to solve the problem, unlike when you say that "processor means coupled to input output means so that they compute a function such that the result of said function when output through said output means solves the problem the user wanted to solve".

  1. the invention embodying the computer-implemented software is not working as an independent machine or technical invention, and
  2. the patent is not in conflict with European competition law.
Synopsis:
Amendments 20 and 50 are the only one that formulate a real interoperability privilege. However, the word "computer systems and network" should, for greater clarity, be changed to "data processing systems", as proposed by amendment 50. Amendment 20 was already accepted in CULT, ITRE and JURI.

Amendment 76 removes all clarity about when use of patented techniques for interoperation is allowed and when not. It runs counter to the main purpose of the directive, which is to concretise certain abstract meta-rules, including those of Art 30 TRIPs, and thereby achieve clarity and legal security.

It is nice that amendment 105 agrees with us that a "computer-implemented invention" cannot mean anything else but software running on a computer. However, the exceptions it mentions are very strange. In the first case, if the invention is an independent machine, there is no interoperability requirement. If there is no interoperability requirement, amendment 20 also won't apply. Conversely, if there is such a requirement, then the patented invention will not be working as an independent machine or technical invention. The second clause is quite dangerous, as it leaves everything for the courts to decide, thus failing to achieve the directive's aim of clarification. As the anti-trust cases against Microsoft in both the USA and in Europe shows, it is extremely difficult and time-consuming to determine whether any behavior violates existing competition law. This would render the interoperability clause toothless and put SME's even more at a disadvantage, as large companies have much more money to spend on court cases.

Amendment 71 calls for creation of an insurance system for patent acquisition and litigation, although there is no practical example of such a working system. The theoretical possibility as suggested by a consultants report to DG MARKT is also based on wrong assumptions, as explained in open letter to the European Parliament written by a number of distinguished economists.

Amendment 90 is like 71, but less explicit.

Both amendments 71 and 90 call for an insurance for promotion not of defence of software companies against patent aggression, but, on the contrary, of aggressive use of patents by specialised patent litigation SMEs such as Eolas and Allvoice against software companies. The archetype for the "Patent Defence" concept is the "Patent Defence Union" created by the CEO of Allvoice Computing PLC. Allvoice is the "ten-person company located in an employment blackspot in south-west England" which Arlene McCarthy praises in her JURI Draft Report. Allvoice has hardly produced any software itself, certainly not speech recognition software, but it used two trivial and broad patents on user interfaces in order to extort money from real speech recognition software companies. By promoting the Patent Defence scheme as set out in this amendment, MEPs should note that they would be promoting litigation instead of innovation.

Several EU studies on SMEs and software patents have found that there are systematic reasons why SMEs are not using the patent system. These are unlikely to be overcome by any proselytising system, no matter how much public money is poured into it.

Synopsis:
It is possible to correct the directive using the tabled amendments. If the right amendments are adopted, the directive could be beneficial for the EU. So adopting a thoroughly corrected directive would be better than rejection. On the other hand, amending a directive this thoroughly is a complex task, especially in plenary, and the European Parliament may not succeed in fixing the abundant assumptions and misconceptions introduced by the Commission. The directive went through a procedure that hasn't taken into account most interested parties, academic studies or evidences. Rejecting the text and asking the Commission to start over with due process would also be justified. In fact, the number of mistakes needing correction is so large, that relying on the results of plenary vote for a good directive is very risky. Given the risk to the progress, freedom and the EU-companies' ability to compete if the amending partially fails, rejection is more desirable. This is legislation for the next 20 years. Although it has already taken some time, we are still in an early process of understanding and not in a hurry.

On the one hand it equates "present legal position" (?) with "practices of the European Patent Office". On the other it says that the patentability of business methods is to be avoided. However the EPO itself has been granting many patents for business method and has provided legal reasoning to support business method patents. The only possible effect of the amendment, if any, would be to surrender legislative responsability to the EPO, whose practices would seem to define patentability instead of abiding to the laws voted by the European Parliament and other democraticaly representative bodies.

Amendment 86 does not ask for a codification of the current EPO practice, but on the other hand talks about "unpatentable methods such as trivial procedures and business methods". Not just trivial business methods must remain unpatentable, but all business methods must remain so (otherwise we are deviating from Art 52 EPC, which should be avoided as suggested in amendment 88).
