Austria and Software Patents
The Austrian government has for a long time been hijacked by patent alwyers. It always took the most radical pro patent positions in the international patent policy fora. Austria introduced "program logic utility certificates" in the early 90s in an attempt to prevent patent expansion into this area while providing a more light-weight system for experimenting with exclusivity of algorithms. However, due to the intrusion of patents into the same field, the utility certificate with its shorter duration wasnot much used. The Austrian Chamber of Commerce has published an anti-swpat statement in 2000.
Of the austrian MEPs, Maria Berger from PSE (SPÖ) initially took a hardline pro-patent position, tabling an amendment in favor of program claims in JURI. Christa Prets from the same party was more critical. Mercedes Echerer (Greens) was one of the most vocal critics. Othmar Karas led the conservative (ÖVP) group into a critical position fairly early, in contrast to the pro-patent hardliners

Harbour who were leading the EPP. His colleague Paul Rübig of SME Union also supported this approach. Both signed the amendments of Piia-Noora-Kauppi in the final vote. FPÖ also took a patent-critical position. Thus, in sharp contrast with its position in the Council, Austria appeared as an almost completely patent-critical country in the Parliament.

- In this confidential paper, an anonymous patent official from Austria's Ministery for Transportation, Innovation and Technology (BMVIT) instructs Austria's diplomats in the EU Council to fully support the position of the Council working party on patentability of software. To justify this position, he claims that it represents a compromise with the software patent critics and excludes the patentability of algorithms, business methods and pure software. He bases this assertion on some a few ambivalent recitals from the Council document. Moreover, the BMVIT official says it must be the goal of the EU directive to make nothing unpatentable for which the European Patent Office (EPO) has already granted patents. He accuses the European Parliament of having sided with the software patent critics and restricted patentability in unacceptable ways. In particular, calculation rules must be patentable, if they help save time or space on a universal computer, because such an effect is "technical". A definition of "technical" in terms of "forces of nature", as proposed by the German delegation, is deemed "unnecessary" by Austria. He doesn't try to explain how the position of the European Patent Office is more advantageous for Austria than that of the European Parliament. The text assumes that the patent office is an unquestionable authority whose higher wisdom must in any case prevail over the elected legislature. The writer himself probably is from the Austrian Patent Office, which is organisationally a department of BMVIT.
Othmar Karas 2004-04: Brief an AT-Regierung
- Der Wirtschaftspolitische Sprecher der Österreichischen Volkspartei (ÖVP) und der Europäischen Volkspartei im Europäischen Parlament, MdEP Othmar Karas, schrieb zwei Wochen vor der Herausgabe der "Weisung" einen Brief an zuständige Mitglieder der österreichischen Regierung, in dem er die Praxis des Europäischen Patentamtes kritisierte und die Regierung aufforderte, die Position des Europäischen Parlamentes zu unterstützen und den Gegenentwurf der Irischen Ratspräsidentschaft abzulehnen. Bis zum 5. Mai (als die "Weisung" herauskam) hatte es noch keine Antwort gegeben.

IV-net.at 2003/04/24: Schreiben an Österreichische Europa-Parlamentarier
- Stephan Maras, der den Ausschuss für Gewerblichen Rechtschutz bei der Österreichischen Industriellen-Vereinigung leitet, fordert im Namen der Maschinenbauer und Elektronikhersteller, dass nicht nur programmierte Industrieprozesse sondern vor allem reine Datenverarbeitungsprogramme direkt patentierbar und als Texte beanspruchbar sein müssen. MdEP Malcolm Harbor (brit. Konservative) werde einen Änderungsantrag in diesem Sinne stellen. Ferner meint Maras, das Urheberrecht sei nur für Gedichte geeignet und sei im Falle von Computerprogrammen sehr leicht zu umgehen, nämlich durch bloße Übersetzung von C nach Perl. Diese Ausführungen sandte Maras am 24. April 2003 zusammen mit einem ähnlich beschaffenen Schreiben großer Industrieverbände an die österreichischen Abgeordneten im Europäischen Parlament.
